1. Objectives and General Considerations

These General Conditions are intended to regulate the Terms and Conditions by which the website www.lusitanovillas.com, owned by Lusitano Garden Villas, Unipessoal, LDA, with tax identification number 516662066, headquartered at Rua Padre Camilo Martins, 11, 9545-152 Capelas, hereinafter referred to as Lusitano Garden Villas, will be governed.

The Terms and Conditions presented apply to the relationship between the visitor, hereinafter referred to as the Client, and Lusitano Garden Villas, the functionalities and rules of the website, and the rules concerning the stay, including operational aspects, schedules, and services provided, as well as other relevant information.

The use of the Lusitano Garden Villas website implies the full acceptance and agreement with all parameters present in the Terms and Conditions described here, as well as the Privacy and Cookies Policy currently in effect on the website. If you do not accept, either partially or entirely, any of the stipulated conditions, you should not take any action on the site.

Lusitano Garden Villas reserves the right to update, alter, delete, or exchange any content of the Terms and Conditions, as well as the website, without prior notice. It is advisable to periodically check the Terms and Conditions for any changes or updates.

In situations not provided for in the Terms and Conditions, applicable legislation will be invoked.

2. Prices

All prices on the website are presented per room for the entire stay, including VAT and all taxes, unless otherwise stated on the site or in the confirmation email. Sometimes there are more economical rates available on our website, depending on various variables such as the number of people, selected meal plan, or the period of stay. Please carefully check the room description and rate before making your reservation.

The price of the stay to be paid by the Client constitutes the consideration for the use of accommodation during the period between arrival and departure.

Published prices may be changed without prior notice.

The stay of children up to 2 years old is not charged, provided they stay in the room of the adults responsible for them. Lusitano Garden Villas must always be informed of the inclusion of a child in the reservation so that accommodation adjustments can be made if necessary.

No additional cost for the use of a crib. Maximum capacity of one crib.

The use of a sofa bed will incur an additional cost of €50.00 and €30.00 for children aged 3 to 12.

It is the total responsibility of the Client to inform Lusitano Garden Villas of the number of people (adults and children) who will occupy the accommodation.

In case more people show up than specified in the reservation, the Client’s entry may be refused without a refund.

3. Check-In and Check-Out

Lusitano Garden Villas provides accommodation from 2:00 PM on the arrival date.

Upon arrival (check-in), the Client must identify themselves and provide identification documents, namely an identity card or passport.

The Client must vacate the accommodation, free of people and belongings and without any damage, by 12:00 PM on the departure date.

If the accommodation is not vacated by the time defined in these Terms and Conditions, without any justification or prior consent from Lusitano Garden Villas, a compensation corresponding to the price of one night will be charged. The Client only has the right to use the accommodation during this period if it is available.

4. Services

Lusitano Garden Villas offers the following services to its clients:

• Free private parking
• Laundry/ironing service
• Spa: Turkish bath and sauna
• Gym
• Outdoor pool
• Outdoor Jacuzzi
• Bar
• Riding arena
• Horseback riding lessons
• Equestrian experiences
• Visits to the farm
• Cleaning service
• WiFi

5. Payment Conditions

• 50% of the total stay value at the time of booking
• 50% two weeks before arrival

The initial payment of 50% of the accommodation and other reserved services must be made at the time of confirming the reservation. The reservation will only be finalized after payment confirmation.

This amount, along with the cancellation fee, will be specified at the time of booking and may vary depending on the promotional rate or the type of accommodation chosen by the Client.

Lusitano Garden Villas accepts the following payments:

• Credit/Debit Card: For this payment method, you will be asked to provide your card details to guarantee your reservation. All payments will be processed securely, and the handling of the provided data is confidential and non-transferable. Credit card charges will be made solely by Lusitano Garden Villas. Lusitano Garden Villas commits to responding to any cardholder request within a maximum of two days. It is recommended to keep a copy of the transaction details for future reference if needed. The transaction will be carried out by the company Lusitano Garden Villas, Unipessoal, LDA., after confirming the reservation, at which point the respective digital voucher with detailed information will be sent. Lusitano Garden Villas ensures the refund of the reservation amount in case of a valid exercise of the consumer’s right of withdrawal, if applicable, as defined in consumer protection legislation.
• Cash: On-site payment.

6. Cancellation Policy

The cancellation policy is common to all reservations made on the website, applying to all bookings with a mandatory deposit.

• Cancellations made more than 30 days before arrival: 10% of the total non-refundable reservation value, and the remaining payment already made can be used for a stay with arrival up to 6 months after the canceled stay.
• Cancellations made between 15 and 30 days before arrival: cancellation fee (non-refundable) of 50%, and the remaining payment can be used for a stay with arrival up to 6 months after the canceled stay.
• Cancellations made less than 14 days before arrival: the entire payment is non-refundable.

   Complaints Regarding Material Defects

The Client must inspect the room upon arrival and immediately report any defects found to the hotel reception.

Any defects that arise during the stay should be reported to the hotel reception as soon as the Client becomes aware of them.

If it is determined that there is indeed a defect in the Client’s room, Lusitano Garden Villas has the right to choose between repairing it and relocating the Client to a room that is at least of the same category contracted with the Client.

For the purposes mentioned above, only serious defects that are likely to compromise the level of service and quality will be considered, and Lusitano Garden Villas is not obliged to take any action if the complaints are irrelevant, unreasonable, or related to details that do not affect the minimum level of contracted service.

If Lusitano Garden Villas is unable to repair the relevant defect or replace the Client’s room with another of equivalent or superior category, the Client may only terminate the contract and receive the price paid for the room, without demanding anything else from Lusitano Garden Villas, under any circumstances.

8. Responsibility of Lusitano Garden Villas

Lusitano Garden Villas is responsible for ensuring the appropriate conditions of hygiene, cleanliness, and safety of the accommodation.

Lusitano Garden Villas is not responsible for personal belongings that may disappear within the hotel.

9. Rights and Duties of the Client(s)

Client’s Rights:

• Confidentiality on the part of Lusitano Garden Villas regarding the use of the personal data of the Client(s).
• Housekeeping and cleaning of the accommodation.
• Free Wi-Fi.

10. 
    Customer Responsibilities

• Respect the rules established by the collaboration in compliance with these Terms and Conditions.
• Honor the personal dignity of Lusitano Garden Villas’ staff, guests, and/or others.
• In the event of theft, property damage, fire, floods, anomalies, or deficiencies in the accommodation, as well as during the stay in general and the services provided, the Client must immediately report to Lusitano Garden Villas’ staff so that they can be resolved as quickly as possible.
• Use Lusitano Garden Villas, accommodations, and spaces appropriately and carefully, taking responsibility whenever causing any harm to the accommodation.
• Do not claim ownership of the belongings belonging to the accommodation unit.

11. Rules

• The Client(s) must not use devices that may endanger the safety of people and Lusitano Garden Villas’ facilities.
• Smoking is prohibited inside Lusitano Garden Villas, rooms, and common areas. There are designated smoking areas.
• Carrying a weapon or cutting instrument that may endanger one’s life and others is prohibited.
• Out of respect for all guests, special attention is requested for silence in common areas. Noise production or activities causing noise are not allowed between 11:00 PM and 7:00 AM.
• Pets are not allowed.
• Common areas are monitored by cameras.
• Lusitano Garden Villas is not responsible for damages or theft in the property’s parking.

12. Damages and Losses on the Property

The Client is obligated to indemnify Lusitano Garden Villas for any damages caused to the accommodation and/or its facilities/support areas, as well as damages arising from the violation of duties outlined in these Terms and Conditions, including attorney fees and legal costs.

13. Complaints and Compliments

Lusitano Garden Villas provides a complaints book and a compliments book.

Legal Provisions

Unless stated otherwise, the software necessary for our services, available or used by our website, and the intellectual property rights (including copyright) of the content, information, and material on our website are the property of Lusitano Garden Villas, Unipessoal, LDA., its suppliers, or providers. To the extent permitted by law, these terms and conditions and the provision of our services shall be governed and construed in accordance with Portuguese law, and any dispute arising from these general terms and conditions and our services will be submitted to the competent courts of Ponta Delgada, Portugal.
